CONTEST SPONSOR: Shuckman's Fish Company & Smokery 3001 West Main Street Louisville, Kentucky 40212 CONTEST DESCRIPTION The Shuckman's Gourmet Seafood Recipe Contest (the "Contest") is open only to legal U.S. residents who are at least 18 years of age as of January 1, 2006. All federal, state and local laws and regulations apply and the Contest is void where prohibited or otherwise regulated. The term "Sponsor" or Shuckman's refers to Shuckman's Fish Company & Smokery. The Contest officially begins at 12:00:01AM EST on January 1, 2006 and ends at 11:59PM EST on June 30, 2006. PRIZES One (1) GRAND PRIZE WINNER will receive the Shuckman's Gourmet Super-Sampler: · 4oz. Spoonfish Caviar · 16oz. Smoked Nova Salmon · 16oz. Smoked Alder Salmon · 16oz. Smoked Spoonfish · Shuckman's Fish Company & Smokery Kitchen Apron Total Retail Value including delivery: $73.79 At its discretion, Shuckman's Fish Company & Smokery shall have the right to substitute another prize package of equal or greater value. Prizes are not transferable and no substitution of the prize will be permitted, except by Shuckman's Fish Company & Smokery. ENTRY No purchase necessary to enter or win. All entries must be original recipes created by the entrant using at least one product from Shuckman's Fish Company & Smokery and must contain not more than 10 ingredients (not including the required Shuckman's Fish Company & Smokery product(s), water, salt, and pepper). For each recipe submitted, list each ingredient (including garnishes) in exact U.S. measurements and include step-by-step preparation/cooking instructions. You may enter as many different recipes as you would like, as long as each recipe fulfills the entrance criteria for this contest including the rules listed below at "Submission of Entry". Entries must not have been entered in any other contest or been published and must not violate another party's copyright, intellectual property, or other rights. Contestant finalists will be required to certify that the recipe entry is original. Entries will not be acknowledged or returned. Limit one entry per envelope or online form submission. CRITERIA FOR JUDGING Final judging will be conducted by Shuckman's Fish Company & Smokery and its panel of judges and will be based equally on the following criteria: · Use of Shuckman's Fish Company & Smokery's product · Taste of the finished recipe · Originality and creativity · Appearance and overall presentation of the prepared recipe AWARDING OF PRIZES Winners of the contest will be notified by telephone, the U.S. Postal Service, or electronic mail no later than July 1, 2006. In case of dispute as to identity of winner who enters by e-mail, the entry will be declared made by the registered user of the e-mail account, and if a prize is won, it will be awarded to the registered user. Each winner must execute and return to Shuckman's Fish Company & Smokery within 10 days of the date on the prize notification (i) an affidavit giving Shuckman's Fish Company & Smokery and its nominees full rights to use the winner's name, hometown, and photograph or likeness in connection with the winning recipe and this contest for all media advertising, product packaging, and/or trade purposes, including usage on the Shuckman's Fish Company & Smokery website without further compensation, and (ii) a release of liability on such terms specified by Shuckman's Fish Company & Smokery, or the prize will be forfeited and awarded to an alternative winner. SUBMISSION OF ENTRY Each entry must be submitted via the entry form on the Shuckman's Fish Company & Smokery website or typed plainly or written legibly (in English) and sent via the U.S. Postal Service to: Shuckman's Gourmet Seafood Recipe Contest 3001 West Main Street Louisville, Kentucky 40212 Your name, street address including apartment number, city, state, zip code, and daytime and evening telephone numbers must be included with the recipe. If the prize or prize notification letter is returned as undeliverable, the prize will be forfeited and awarded to an alternate winner. No entries will be accepted by telephone, express mail delivery service or fax and no incomplete, illegible or otherwise invalid entries will be accepted. In the case of a duplicate recipe submission, the first recipe received will be included in the judging. Shuckman's Fish Company & Smokery reserves the right to post contest entries on their website at the conclusion of the contest. By submitting a recipe, each entrant accepts these rules and agrees to be bound by the decision of the judges, which shall be final in all matters relating to this contest. DEADLINE FOR ENTRY Entries must be received by Shuckman's Fish Company & Smokery on or before 11:59PM EST on June 30, 2006. Shuckman's Fish Company & Smokery shall have no responsibility for lost, late, or misdirected, damaged or postage-due entries or for problems or technical malfunctions of the computer system, phone line, hardware, software or program malfunctions or other errors failures of any kind, delayed computer transmissions or network connections. Shuckman's Fish Company & Smokery reserves the right in its sole discretion to cancel or suspend this contest, in its entirety or only the Internet portion, should virus, bug or other causes beyond Sponsor's control corrupt the administration, security or proper play of the contest. Shuckman's Fish Company & Smokery also reserves the right to cancel the Contest at any time due to printing or other errors, without liability, and entrants waive any claims against the Sponsor with respect to such cancellation. ELIGIBILITY Employees of Shuckman's Fish Company & Smokery, its wholesalers and vendors, website design and promotion staff, advertising or promotional agencies, and the immediate families and household members of each, as well as individuals who prepare food or create recipes on a professional basis (such as a chef, home economist, or food writer) are not eligible. MISCELLANEOUS Entrants and winners agree that Shuckman's Fish Company & Smokery, its affiliates, officers, employees, directors and agents are not liable and assume no responsibility or liability of any kind whatsoever for any injury, claim, cause of action, loss or expense, including attorneys' fees, incurred in connection with this contest or attributable to acceptance, possession or use of any prize. Any federal, state or other taxes are the sole responsibility of the individual winners. Shuckman's Fish Company & Smokery is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or used in the contest or by any technical or human errors which may occur in the processing of the entries in the contest.
